Hanbali Ramadaan Fiqh
Allah has made it an obligation upon humans to fast under four conditions
1. al-Islam. It is not obliged on the Kaafir Asli [The generality of non Muslims that have not embraced Islam] and the Kaafir Murtad [The apostate who has left Islam]to fast.
2. 'Aql, that they be of sound mind and not crazy [majnoon - mentally ill or mentally impaired]
3. al-Bulugh, that the person has reached the age of discrimination/ maturity. Children are exempt from fasting. Although there is a weak hadeeth which stipulates that if a child has the ability to fast for three days in Ramadaan, then they obliged to fast the rest of the month. However, this hadeeth is weak.
4. al-Qaadir, the one who is cable to fast
Ramadaan begins with the Sighting the Moon
It is obligatory to start fasting when
a. the 30 days of the month of Sha'ban has been completed
b. The crescent moon [the hilaal], signifying Ramadaanhas started, has been sighted
c. The moon sighting is not possible due to cloudy skies and it is the 30th of Sha'ban
With any of these three conditions fulfilled, it is obligatory on the individual to start fasting, even if he witnessed one of these conditions alone. He does not need a witness.
If this person, who sighted one of the three conditions, is trustworthy then people should fast based upon his witness account. However, the witnessing at the end of Ramadaan requires two trustworthy people to sight the moon.

The types of people that should not fast or are permitted not to fast
A sick person that could possibly do themselves harm by fasting
The traveler [however they must make it up]
The women who is menstruating or has post natal purity
The pregnant women or mothers who are breastfeeding their children
The elderly
A sick person who has no chance of recovery
Children below the age of discrimination
Those things that negate the fast
Backbiting and slander
Eating, or drinking
Any sexual act
Cupping or any other similar operation
Taraaweeh – The Ramadaan night prayer [after Ishaa]
Taraaweeh behind the Imaam or alone at home is both counted as the Sunnah. Behind the Imaam in the masjid is more superior in merit.
There is a type of consensus about the 20 rakaa’ah behind the Imaam. The Sahaabah are in Ijmaa’a Sukuti regarding this. Since the school if Imaam Maalik differ to the number, this demonstrates that there was not a complete consensus regarding their number. Imaam Malik’s opinion [with evidence] is that the number of Rakaa’ah is thirty two.
The argument that taraaweeh is eight Rakaa’ah cannot be found in any classical fiqh text of the Ahl us-Sunnah wal-Jamaa’ah, nor any text predating 1900. This is a new argument constructed by the people of innovation.
Also in the Hanbali school, one is allowed to hold a Mushaf of the Qur’an whilst the Imaam is reciting provided that they have a respectful place for the Qur’an when going into ruku or sadjah.
So no beating up your fellow Hanbali brothers after the Jamaa’ah!!
I’tikaaf –Seclusion
I’tikaaf refers to total seclusion in the last ten days of Ramadaan. Men do this in the masjid whereas women do this at home in their place of prayer. It is a time of pure worship and every minute therein, one should be engaged in doing good deeds in order to draw closer to Allah. All other things should be avoided, especially over socializing and speaking about dunyah issues.
Total seclusion also means that men are to totally seclude themselves within the masjid and not exit the masjid unless for a valid reason. On the 29th day of Ramadaan, Zakat al-Fitr has to be paid the maghrib before ‘Eid. The said amount is one measure of wheat or barley. The latest this can be paid is before the ‘Eid prayer.
